  1. ACCEPTANCE OF TERMS
  2. The eSerbisyo Web Portal (“eSerbisyo”), established and administered by the Land Registration Authority (“LRA”), provides its service to you subject to the following Terms and Conditions, which may be updated by us from time to time without notice to you. By accessing and using our website, you agree to comply with and be legally bound by the Terms and Conditions hereof. In addition, when using third party Internet services, you and the Service Provider shall be subject to any posted guidelines or rules applicable to such services. All such guidelines or rules are hereby incorporated by reference into the Terms and Conditions.

    The term “eSerbisyo” refers to the eSerbisyo Web Portal and the term “you” refers to any user of our site.

  3. DESCRIPTION OF SERVICE
  4. eSerbisyo is a web based application that allows clients to request for a Certified True Copy (“CTC”) of a title through the web portal. You understand and agree that these services may include certain communications from eSerbisyo, such as service announcements and advertisements, administrative messages and news updates, and that these communications are considered part of eSerbisyo membership and you will not be able to opt out of receiving them.

  5. ENHANCEMENTS AND ERRORS
  6. Unless explicitly stated otherwise, any new features that augment or enhance the current eSerbisyo shall be subject to the herein Terms and Conditions. LRA does not warrant nor represent nor assume any responsibility as to the timeliness, accuracy, reliability, deletion and misdelivery of information available on or through eSerbisyo, or failure to store any user communications or personalization settings. LRA also does not warrant that eSerbisyo will be error-free, free of viruses, or other harmful components or defects. You are responsible for obtaining access to eSerbisyo, and that access may involve third-party fees (such as internet service provider or airtime charges). In addition, you must provide and are responsible for all equipment necessary to access eSerbisyo.

  7. YOUR REGISTRATION OBLIGATIONS
  8. You agree to: (a) provide true, accurate, current, and complete information about yourself or your company as prompted by the online member/employer USER ID registration, and (b) maintain and promptly update your registration information to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, or the LRA has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, LRA has the right to suspend or terminate your account and refuse any and all current or future use of eSerbisyo (or any portion thereof).

  9. YOUR PASSWORD AND ACCOUNT SECURITY
  10. A Password and User ID shall be required when accessing your eSerbisyo account. You are responsible for ensuring that your Password and User ID are secured and that your eSerbisyo account cannot be accessed by unauthorized persons. You are solely responsible for any loss due or other fraudulent activities associated with the sharing of your Password and User ID to a third person, and LRA shall be held free from any liability arising from access or use of the account by a third person, whether such access or use of the third person was with or without authority granted by you as the holder of the account. LRA shall automatically block or disable access to the account in case a wrong password is entered after a given set of tries.

  11. RESTRICTIONS ON USE
  12. Your access to eSerbisyo and the use of your eSerbisyo account is subject to the following restrictions:

    1. Unless otherwise stated, eSerbisyo and the materials in eSerbisyo are protected by proprietary rights (including but not limited to intellectual property rights). You may download forms, view and print your LRA information from eSerbisyo for your own personal use only, and you must not republish, sell, rent, reproduce, duplicate, copy, modify, sell, trade, resell or exploit for any commercial purposes any portion of eSerbisyo or access to eSerbisyo.
    2. You must not use eSerbisyo in any way that causes, or may cause, damage to eSerbisyo or impairment of the availability or accessibility of eSerbisyo; or in any way which is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
    3. You must not use eSerbisyo to copy, store, host, transmit, use, publish, or distribute any material which consists of (or is linked to) any spyware, computer virus or other malicious computer software.
    4. You must not conduct any systematic or automated data collection activities in relation to eSerbisyo without LRA's express written consent. The accounts of users who will violate or abuse the use of eSerbisyo or abuse the use of information downloaded from eSerbisyo may be disabled and/or terminated by LRA without prior notice.

  13. LINKS TO OTHER SITES
  14. Third party content from member agencies may appear on or may be accessible via links from eSerbisyo. LRA is not responsible for and assumes no liability for their contents or for any loss arising from access to these websites. Use of the hyperlinks and access to such linked websites are entirely at your own risk. Information and opinions in the third party content are neither endorsed by LRA nor does it necessarily reflect LRA's beliefs.

  15. COMPLIANCE WITH APPLICABLE LAWS
  16. You must comply with all applicable laws regarding the proper use of eSerbisyo as a website on the internet. Your unauthorized use of eSerbisyo or unauthorized, improper or fraudulent use of your account shall subject you or any third party to a claim for damages, and/or criminal liability in accordance with applicable laws, including but not limited to the following provisions of law:

    1. Hacking or cracking or interference in a computer system/server or information and communication system; or any access in order to corrupt, alter, steal, or destroy using a computer or other similar information and communication devices, without the knowledge and consent of the owner of the computer or information and communications system, including the introduction of computer viruses and the like, resulting in the corruption, destruction, alteration, theft, or loss of electronic data messages or electronic documents shall be punished by a minimum fine of One Hundred Thousand Pesos (P100,000.00) and a maximum commensurate to the damage incurred and a mandatory imprisonment of six (6) months to three (3) years, as provided in Section 33(a) of the Philippine Electronic Commerce Act.
    2. Piracy or the unauthorized copying, reproduction, dissemination, or distribution, importation, use, removal, alteration, substitution, modification, storage, uploading, downloading, communication, making available to the public, or broadcasting of protected material, electronic signature or copyrighted works including legally protected sound recording or phonograms or information material on protected works, through the use of telecommunication networks, such as, but not limited to, the internet, in a manner that infringes intellectual property rights shall be punished by a minimum fine of One Hundred Thousand Pesos (P100,000.00) and a maximum commensurate to the damage incurred and a mandatory imprisonment of six (6) months to three (3) years, as provided in Section 33(b) of the Philippine Electronic Commerce Act. LRA reserves the right to investigate complaints or reported violations of the Terms and Conditions herein and to take appropriate actions against those found to be in violation. You must timely inform LRA of any knowledge of improper or illegal use of eSerbisyo or your eSerbisyo account.

  17. LIMITATION OF LIABILITY
  18. The information and services offered by eSerbisyo may contain bugs, errors, problems or other limitations. To the maximum extent permitted by applicable laws, in no case shall LRA be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business or personal profits, business or personal interruption, loss of business or personal information, or any other pecuniary loss) arising out of the use or inability to use eSerbisyo.

  19. PRIVACY POLICY
  20. This Privacy Policy is hereby adopted in compliance with Republic Act No. 10173 or the Data Privacy Act of 2012, its Implementing Rules and Regulations, and other relevant policies, including the issuances of the National Privacy Commission (“NPC”).

    The organization respects and values your data privacy rights and makes sure that all personal data collected from you, our clients and customers, are processed in adherence to the general principles of transparency, legitimate purpose, and proportionality.

    Your Rights

    Subject to the requirements, conditions and exemptions under the Data Privacy Laws, you are entitled to the following rights:

    1. To be informed that your personal data will be, are being, or were collected and processed;
    2. To obtain from the organization a copy of any information relating to you that we have on our database and/or manual filing system;
    3. To object if the personal data processing involved is based on consent or on legitimate interest;
    4. To suspend, withdraw or order the blocking, removal, or destruction of your personal data;
    5. To claim compensation if suffered damages due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of personal data, considering any violation of your rights and freedoms as data subject;
    6. To file a complaint with the NPC;
    7. To dispute and have corrected any inaccuracy or error in the data a personal information controller (“PIC”) hold about you; and,
    8. To manage your personal data in your private device, and to transmit data from one personal information controller to another.

    Scope and Limitations

    All personnel of this organization, regardless of the type of employment or contractual arrangement, must comply with the terms set out in this Privacy Manual.

    Collection, Use, Storage, Access and Disclosure of Personal Information

    1. We collect the basic contact information of clients and customers, including their full name, address, email address, contact number, together with the service that they would like to use.
    2. Personal data collected shall be used by the company for documentation purposes and for tracking services transactions.
    3. We will ensure that personal data under its custody are protected against any accidental or unlawful destruction, alteration and disclosure as well as against any other unlawful processing. The company will implement appropriate security measures in storing collected personal information, depending on the nature of the information.
    4. Only the authorized representative of the company shall be allowed to access such personal data, for any purpose, except for those contrary to law, public policy, public order or morals.
    5. All employees and personnel of the company shall maintain the confidentiality and secrecy of all personal data that come to their knowledge and possession, even after resignation, termination of contract, or other contractual relations. Personal data under the custody of the company shall be disclosed only pursuant to a lawful purpose, and to authorized recipients of such data.

  21. LAW, JURISDICTION, AND DISPUTE RESOLUTION
  22. The Terms and Conditions constitutes the entire agreement between you and LRA. If any provision of this Terms and Conditions is found to be invalid or unenforceable for any reason, such invalidity or unenforceability shall not affect other provisions of this Terms and Conditions which shall remain in full force and effect. This Agreement shall be treated as if executed and performed in Quezon City, Philippines, and shall be governed by and construed in accordance with Philippine laws. Any suit or proceeding arising out of or relating to this Terms and Conditions shall be instituted in the appropriate court of Quezon City. All actions and controversies that may arise from the implementation of this Terms and Conditions shall be submitted to mediation and/or arbitration in accordance with the provisions of Republic Act No. 9285 otherwise known as the “Alternative Dispute Resolution Act of 2004”.
